We reserve the right to limit the quantities of any products or services that we offer. All descriptions of services or service pricing are subject to change at anytime without notice, at the sole discretion of us.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household/business or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 7 – RECURRING BILLING AND TERMINATION
McClure Fitness Live, LLC is a paid, auto-renewing subscription service. If you purchase a subscription by accepting our trial offer, you are agreeing to automatic (recurring) billing, and agree to pay the charges made to your account in connection therewith. Your Subscription, and monthly billing of your account, will continue indefinitely until cancelled by you. Your subscription automatically renews on a month to month basis with each renewal occurring exactly one month after you initiate your membership. If you choose to cancel and do so after you have been billed for a particular month, McClure Fitness Live, LLC will not refund you that past month’s fee.
There will not be any reminders when your account will renew for another month. By agreeing to these Terms and Conditions you are agreeing to recurring automatic billing. To continue your membership, you don’t need to do anything. Your membership will automatically renew and your credit card will be processed for the next term. If we do not have a current credit card on file, your membership will expire and you will not have access to your account until it is paid for. If this is the case, you will be prompted to renew when you login. As soon as you renew you will be able to access the account.
You are entirely responsible for canceling your account. If you wish to cancel, you MUST do so through your My Account page (My Account > Profile > Subscriptions). We do not accept phone or email cancellations. McClure Fitness Live, LLC does not offer any refunds. Your account will automatically renew on a month to month basis exactly one calendar month after you initiate service. If you choose to cancel and do so after you have been billed for a particular month, McClure Fitness Live, LLC will not refund you that past month’s fee.
If you cancel your account, we are only responsible for keeping any content or info in our system for one month after the cancellation date. After the one month, we can delete the content.
For trials – if you wish to not continue after the trial period you must cancel your subscription within the trial period.
SECTION 8 – OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

LICENSE: McClure Fitness Live, LLC grants you a limited, non-exclusive license to access and use the service for your own personal, non-commercial purposes. This includes the right to view content available on the McClure Fitness Live, LLC platform. This license is personal to you and may not be assigned or sublicensed to anyone else.
RESTRICTIONS: Except as expressly permitted by McClure Fitness Live, LLC in writing, you will not reproduce, redistribute, publicly display, sell, create derivative works from, decompile, reverse engineer, or disassemble the Daily Burn Service. Nor will you take any measures to interfere with or damage the Daily Burn Service. All rights not expressly granted by McClure Fitness Live, LLC are reserved.

In no case shall McClure Fitness or McClure Fitness Live, LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the lowest level of liability extent permitted by law.

By subscribing to McClure Fitness Live, LLC with the intent of using the service, you affirm that either (A) all of the following statements are true: (i) no physician has ever informed you that you have a heart condition or that you should only do physical activities recommended by a physician; (ii) you have never felt chest pain when engaging in physical activity; (iii) you have not experienced chest pain when not engaged in physical activity at any time within the past several months; (iv) you have never lost your balance because of dizziness and you have never lost consciousness; (v) you do not have a bone or joint problem that could be made worse by a change in your physical activity; (vi) your physician is not currently prescribing drugs for your blood pressure or heart condition; (vii) you do not have a history of high blood pressure, and no one in your immediate family has a history of high blood pressure or heart problems; and (viii) you do not know of any other reason you should not exercise; or (B) your physician has specifically approved of your use of McClure Fitness Live, LLC.
If applicable, You further affirm that (A) you are not pregnant or (B) your physician has specifically approved your use of McClure Fitness Live, LLC.
SECTION 15 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless McClure Fitness Live, LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Jurisdiction and venue shall be solely within the State of Arkansas and the Venue shall be in Saline County, Arkansas.
